This website is operated by Samerao, operated by Jesus Miguel Cuarta Castillo (“Samerao,” “we,” “us,” or “our”).

Samerao provides this website, including all information, content, features, tools, products, and services available through samerao.com (collectively, the “Services”), to you conditioned upon your acceptance of these Terms of Service.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer and sell our products and Services.

Our products are primarily offered to customers located in the United States and Canada and may be manufactured and fulfilled on demand through our production and fulfillment partner, PODpartner.

By visiting our Site, creating an account, purchasing a product, or otherwise using the Services, you agree to be bound by these Terms of Service and any additional policies referenced herein, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.

Please read these Terms carefully before using the Services.

If you do not agree to these Terms, you should not use the Services.

SECTION 1 — ELIGIBILITY AND ONLINE STORE TERMS

By using the Services, you represent that you have reached the age of majority in your jurisdiction or otherwise have the legal capacity to enter into a binding agreement.

You must not use the Services in a manner that violates applicable laws, regulations, intellectual property rights, or the rights of others.

SECTION 3 — PRODUCTS AND MADE-TO-ORDER PRODUCTION

Samerao products may be manufactured specifically for each customer after an order is placed.

We use PODpartner as a production and fulfillment provider for applicable products.

Because products are made to order, production may begin shortly after an order has been confirmed.

Customers are responsible for carefully reviewing all product selections before completing a purchase, including:

  • Product
  • Size
  • Color
  • Design
  • Quantity
  • Shipping address
  • Recipient information
  • Other applicable product options

Please review the applicable size guide before purchasing.

An item that corresponds to the product, size, and color selected by the customer is not considered incorrect merely because the customer expected a different fit, appearance, or size.

Our Return & Refund Policy contains additional information regarding defective, damaged, or incorrect products.

SECTION 4 — PRODUCT INFORMATION

We make reasonable efforts to display our products, descriptions, specifications, colors, designs, and images as accurately as possible.

However, colors and visual appearance may vary depending on your device, screen settings, lighting conditions, manufacturing processes, materials, and other factors.

Minor variations that are inherent to manufacturing or printing processes do not necessarily constitute defects.

Product measurements may also be subject to reasonable manufacturing tolerances.

Where a product has specific sizing information, customers should review the applicable size chart before purchasing.

SECTION 5 — PRICES

Prices displayed on our Site are subject to change without notice.

The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious pricing or technical errors where permitted by applicable law.

Prices may be displayed in currencies appropriate to the relevant market.

Additional charges, including applicable taxes or shipping charges, may be displayed during checkout where applicable.

We reserve the right to modify or discontinue products or promotions at any time, subject to obligations relating to orders already accepted and applicable law.

Availability may vary depending on your location, device, currency, order, and the relevant payment provider.

Payment providers may apply their own terms, eligibility requirements, fraud controls, privacy practices, or other conditions.

Submitting an order does not necessarily mean that we are required to accept it.

After reviewing an order, we may decline or cancel it where reasonably necessary, including in cases involving:

  • Unauthorized payment.
  • Incorrect pricing caused by an obvious technical error.
  • Product or production unavailability.
  • Shipping restrictions.
  • Incorrect or insufficient customer information.
  • Violations of these Terms.
  • Circumstances making fulfillment impossible or unlawful.

If we cancel an order after payment has been successfully collected and no amount is legitimately due for completed production or other circumstances permitted under these Terms and applicable law, the appropriate refund will be issued to the original payment method.

We may contact you if additional information is required to process an order.

SECTION 8 — ORDER CHANGES AND CANCELLATIONS

Because our products are made to order, production may begin shortly after an order is placed.

If you need to modify or cancel an order, contact:

as soon as possible.

We cannot guarantee that an order can be modified or cancelled after it has been submitted.

If production has not started, we may be able to cancel the order and issue the applicable refund.

Once production has started, costs may already have been incurred and cancellation or a full refund may no longer be available.

Once an order has shipped, it cannot be cancelled. Any subsequent claim will be handled according to our Return & Refund Policy.

Customers should therefore carefully verify all order information before completing checkout.

SECTION 9 — SHIPPING AND DELIVERY

Samerao currently primarily serves customers in:

  • United States
  • Canada

Shipping availability may be limited according to our current shipping configuration.

Products may be manufactured and shipped through PODpartner and associated logistics providers.

Production and shipping are separate stages.

Any delivery dates or timeframes displayed on our Site, during checkout, or communicated to customers are estimates unless expressly stated otherwise.

Delivery may be affected by factors outside our reasonable control, including:

  • Carrier delays.
  • Customs procedures.
  • Weather.
  • Peak shipping periods.
  • Remote delivery locations.
  • Transportation disruptions.
  • Government actions.
  • Force majeure events.

Tracking information may be provided after an order has shipped.

SECTION 10 — SHIPPING INFORMATION

Customers are responsible for providing complete and accurate shipping and recipient information.

This includes, where applicable:

  • Recipient name.
  • Street address.
  • Apartment or unit number.
  • City.
  • State or province.
  • ZIP or postal code.
  • Telephone number.
  • Other information reasonably required for delivery.

If you discover an error after placing an order, contact us immediately.

We cannot guarantee that shipping information can be changed after production or fulfillment has begun.

If an order is delayed, returned, lost, or cannot be delivered because the customer provided incorrect or incomplete information, the customer may be responsible for additional storage, handling, shipping, or redelivery costs where applicable.

Such circumstances may not qualify for a refund or free replacement under our Return & Refund Policy.

SECTION 11 — RETURNS, EXCHANGES AND REFUNDS

Because Samerao products are made to order, we do not provide traditional returns or exchanges based solely on customer preference or customer error.

Unless otherwise required by applicable law, we generally do not provide a return, exchange, refund, or free replacement because:

  • The customer selected the wrong size.
  • The customer selected the wrong color.
  • The customer ordered the wrong product or variation.
  • The customer changed their mind.
  • The customer no longer wants the product.
  • The customer expected a different fit despite receiving the size ordered.
  • The customer provided an incorrect or incomplete shipping address.
  • The customer refuses delivery for personal reasons.

This does not affect qualifying claims involving products that are actually defective, damaged, or incorrect.

For example:

If you order size M and receive size M, but the product does not fit as you expected, this generally does not qualify for a return or refund.

If you order size M and receive size L due to a fulfillment error, this may qualify as an incorrect item.

Qualifying defective, damaged, or incorrect products should be reported to Samerao promptly and within the timeframe specified in our Return & Refund Policy.

Photographic or video evidence may be required.

Please review our Return & Refund Policy before purchasing.

SECTION 12 — LOST OR DELAYED SHIPMENTS

If the customer provided a complete and accurate shipping address but an order remains undelivered for an extended period due to a verified logistics issue, please contact us.

We may investigate the shipment with our fulfillment and logistics providers.

Depending on the circumstances and verification of the claim, an appropriate resolution may include a replacement or refund in accordance with our applicable policies.

A carrier tracking status indicating delivery may be considered evidence of delivery, subject to applicable law and any evidence demonstrating otherwise.

SECTION 13 — TAXES, DUTIES AND CUSTOMS

Applicable sales taxes, import taxes, duties, customs charges, or similar charges may depend on the destination, transaction, applicable law, and shipping method.

Where applicable charges are collected at checkout, they will be displayed or incorporated as appropriate.

Where charges are legally imposed directly upon the recipient and are not collected at checkout, the customer may be responsible for paying them.

Customers are responsible for providing information or cooperating with customs authorities or carriers when reasonably required for delivery.

Samerao is not responsible for delays or losses caused by a customer's failure to provide legally required customs information or pay charges for which the customer is legally responsible, except where applicable law provides otherwise.

Unless otherwise stated, the content made available through the Services, including:

  • Samerao branding
  • Logos
  • Product designs
  • Graphics
  • Photographs
  • Videos
  • Text
  • Website design
  • Product descriptions
  • Other original content

is owned by or licensed to Samerao and may be protected by applicable intellectual property laws.

You may access and use the Site for personal, non-commercial shopping purposes.

You may not reproduce, distribute, modify, sell, commercially exploit, or otherwise use protected Samerao content without authorization, except where permitted by applicable law.

Third-party trademarks, logos, and intellectual property remain the property of their respective owners.

If the Services allow you to submit reviews, photographs, comments, feedback, suggestions, or other content, you are responsible for the content you submit.

Our Services may rely on or integrate with third-party services, including Shopify, payment providers, PODpartner, logistics providers, Meta, and other technology providers.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party websites or services that are outside our reasonable control.

Nothing in this section limits any responsibility Samerao has toward customers under mandatory applicable consumer law.

SECTION 17 — PRIVACY

Your personal information is handled in accordance with our Privacy Policy.

Our Privacy Policy explains, among other matters, how information may be processed through Shopify, PODpartner, payment providers, logistics providers, Meta Pixel, customer accounts, and our newsletter.

By using the Services, you acknowledge our Privacy Policy.

SECTION 18 — PROHIBITED USES

You may not use the Services:

  • For unlawful purposes.
  • To violate applicable laws or regulations.
  • To infringe intellectual property rights.
  • To submit false or fraudulent information.

The remaining provisions will continue in effect.

constitute the applicable agreement governing your use of the Services, subject to mandatory applicable law.

These Terms and the operation of Samerao are subject to applicable laws and regulations.

Nothing in these Terms is intended to deprive a consumer of mandatory protections or rights that apply under the laws of their jurisdiction and cannot lawfully be waived by contract.

Where mandatory consumer protection rules apply to a transaction, those rules will prevail over conflicting provisions of these Terms to the extent required by law.
